• Membership grants access to member-exclusive giveaways, offers, and promotions.
• Membership tiers (Silver, Gold, Diamond) provide different levels of benefits and entries into giveaways.
• Memberships are personal and non-transferable.

One-Off Entry Packages

• One-off packages provide a set number of free entries into a specific giveaway without requiring an ongoing membership.

• One-off package entries apply only to the giveaway stated at time of purchase and do not roll over to future giveaways.
• One-off packages are non-refundable and hold no cash value.

Payment Terms and Cancellation Policies

• Membership fees are charged monthly and will automatically renew unless cancelled.
• Payments are processed through secure third-party payment gateways.
• Members may cancel their subscription at any time via their account dashboard.
• Cancellations will stop future payments but will not issue refunds for any remaining period of an active membership.
• Failed payments may result in suspension or termination of membership benefits.

Refund Policy (If Applicable)

• Membership fees are non-refundable once paid.
• Refunds will only be considered under exceptional circumstances in compliance with Australian Consumer Law (ACL).
• Giveaway entries and member perks are non-refundable and have no cash value.

Merchandise Refund & Return Policy

• All merchandise is made-to-order and fulfilled through a third-party provider (Printify).
• We do not offer refunds or exchanges for change of mind, incorrect sizing, or buyer error, as each item is custom printed.
• If your item arrives damaged, defective, or significantly different from the description, please contact us within 7 days of delivery with clear photos, and we will assist with a replacement or refund where appropriate.
• Refunds and replacements for faulty products are handled in accordance with Australian Consumer Law.

Merchandise Purchases & Entries

• Customers who purchase select merchandise items may receive free promotional entries into current giveaways. These entries are valid only for the specific giveaway at the time of purchase and do not carry over to future giveaways unless otherwise stated.

Product Fulfillment & Delivery

• All merchandise is made-to-order and fulfilled through third-party partners like Printify. Delivery times may vary depending on the product type and supplier location. Customers are responsible for providing accurate shipping details. Club Zenith & Lux is not responsible for lost or undelivered items due to incorrect information provided at checkout.

Giveaway Draws

• Winners are selected fairly using a third-party tool RandomDraws.com.au. All draws are conducted in compliance with Australian trade promotion regulations. In the case of major giveaways (prizes valued over $5,000), South Australia (SA) and Northern Territory (NT) residents are not eligible to participate. Non-Australian residents and residents of Australian Capital Territory (ACT) are not eligible to participate in any giveaways.

Member Conduct and Restrictions

• Members must conduct themselves respectfully within any member forums, events, or communications.
• Suspicious activity, fraudulent behavior, or breach of these terms may result in immediate suspension or termination of membership.
• Multiple accounts by the same individual to gain unfair advantages will result in disqualification from giveaways and termination of all associated memberships.

Liability Disclaimers

• Club Zenith & Lux is not responsible for any loss, damage, or injury resulting from participation in giveaways, events, or use of products won.
• Giveaway prizes are provided “as is” and may be subject to manufacturer warranties.
• Club Zenith & Lux reserves the right to modify, cancel, or substitute prizes at any time.
• Club Zenith & Lux reserves the right to disqualify any participant found to be breaching rules or abusing the entry system.

Copyright and Content Usage Guidelines

• All website content, including logos, designs, and text, is the intellectual property of Club Zenith & Lux.
• Members may not reproduce, distribute, or modify any content without express permission.
• Any use of the Club Zenith & Lux name, branding, or content for personal gain without authorization is strictly prohibited.

Giveaway Disclaimer

By becoming a member or customer of Club Zenith & Lux (“the Promoter”), the participant agrees to enter the giveaway (“the Contest”) and further agrees that:

1. Disputes and Legal Claims

• Any and all disputes, claims, and causes of action arising out of or connected with the Contest or any prizes awarded shall be resolved individually, without resort to any form of class action.
• Any claims, judgments, and awards shall be limited to actual out-of-pocket expenses incurred in connection with the Contest. Under no circumstances will Club Zenith & Lux be liable for legal fees.
• Participants waive all rights to claim punitive, incidental, consequential, or any other damages, other than actual out-of-pocket expenses incurred.

2. Limitation of Liability

• In no event shall Club Zenith & Lux, its licensees, affiliates, subsidiaries, promotional agencies, or respective officers, directors, employees, and agents be liable for any damages of any kind, including but not limited to direct, indirect, incidental, consequential, or punitive damages arising from access to and use of this website or participation in the Contest.

3. Tampering and Abuse

• Club Zenith & Lux reserves the right to disqualify any participant found tampering with or abusing any aspect of the Contest at its sole discretion.
• In the event of technical or other issues beyond the Promoter’s control that compromise the integrity of the Contest, Club Zenith & Lux reserves the right to suspend, modify, or terminate the Contest.

4. Malicious Behavior

• Any attempt to damage the website or undermine the lawful operation of the Contest may be a violation of criminal and civil laws. Club Zenith & Lux reserves the right to seek damages to the fullest extent permitted by law.

5. Technical Issues

• Club Zenith & Lux is not responsible for any technical problems involving computer systems, servers, software, email failures, or internet service providers, nor for lost, incomplete, delayed, or misdirected entries.

6. Prize Delivery

• Prizes are sent via Australia Post (or equivalent). A signature is required for delivery. Club Zenith & Lux is not responsible for damage, loss, or theft after delivery has been confirmed via signature.

7. Use of Personal Information

• By entering the Contest, participants consent to Club Zenith & Lux using their personal information for the purposes of administering the Contest and awarding prizes. This includes disclosure to third parties involved in the promotion.
• Unless otherwise advised, Club Zenith & Lux and its partners may use the entrant’s personal information for promotional, marketing, and research purposes, including contact via electronic messages or phone.

8. Winner Announcements

• The names and states/territories of winners may be published in accordance with public announcement obligations (if applicable).

9. Winner Obligations

• It is a condition of prize acceptance that winners must provide a photograph or video of themselves with the prize (or promotional props) within 7 days of receipt.
• Winners may also be required to submit media featuring novelty props (e.g. cheque or promotional card) for Club Zenith & Lux promotional use.

10. Legal Compliance

• The Contest is void where prohibited by law.
• Club Zenith & Lux reserves the right to suspend, modify, or terminate the Contest at any time for security, technical, legal, or operational reasons.

Amendments

• Club Zenith & Lux reserves the right to update these Terms and Conditions at any time. Members will be notified of significant changes via email or website notice.
• Continued use of membership after changes constitutes acceptance of the revised terms.
